What happened
A customer returns a shirt. It is clean — visibly washed. The fabric has a slightly softened hand-feel. The CleverSeal is missing.
What the webshop should consider
Washing is not necessary to establish the nature, characteristics, or functioning of the goods. Under Article 14(2), the consumer is liable for the diminished value.
Most fashion webshops treat a washed garment as unsellable at full price. A significant value reduction — often 100% in premium fashion, less in fast fashion — is defensible.
